| 内容記述 | Although a final and binding civil judgment is generally effective only against the parties of the action, some acts provide that it could be effective even against a third party. In the latter case, a third party who has failed to intervene in the action and whose right is prejudiced by the final judgment does not have the right to file an action for retrial unless otherwise provided. However, a recent judgment of the Supreme Court allowed a shareholder who had received shares by exercising a share option to file an action for retrial of a judgment of invalidation of a new share issue by way of intervention as an independent party. In this paper, I examine the reasons why the current Code of Civil Procedure does not allow an action for retrial by a third party. I also examine whether and to what extent a third party should have the right for retrial. | |||||
