| 内容記述 | Despite Chinaʼs gradual reduction in the application of the death penalty for non-violent crimes, the frequent use of the death penalty for drug offences remains a noteworthy phenomenon. To elucidate this issue, it is necessary to examine the reasons behind the application of the death penalty for drug offences in China. Analysis reveals that the application of the death penalty for drug offences under the current Chinese criminal law is rooted in an unreasonable perception of the social harm posed by drug offences, influenced by historical and political factors. This practice is further shaped by an overemphasis on general deterrence and excessive consideration of public opinion. However, none of these reasons are sufficient to legitimize the use of the death penalty for drug offences. | |||||||||
