| 内容記述 | This article examines how assistance by “Appropriate Adults”（ hereafter “AA”） affects exercising young suspects’ rights to legal advice in the investigation process in England and Wales. The AA scheme is prescribed under the Police and Criminal Evidence Act 1984（ hereafter “PACE”） and the Code of Practice C（ hereafter “Code C”） to safeguard the rights, entitlements and welfare of vulnerable suspects, including juveniles and vulnerable adults, during police investigation. This article focuses only on juvenile suspects. To consider this issue, the article analyzes the empirical data by Miranda Bevan, who examined the functioning of AA support in practice, focusing on the AA’s roles under the Code C and the difference of familial AAs and non-familial AAs. In terms of assistance by AAs involved in providing emotional support for young suspects and facilitating young suspects’ rights, the article concludes that differences between assistance by familial AAs and assistance by non-familial AAs affect understanding and exercising young suspects’ rights to legal advice. | |||||||||
