| 内容記述 | The interim royalty payment order is a type of interlocutory injunction order in India that has frequently been delivered in patent litigations since 2010. Contrary to an ordinary interim injunction order to restrain alleged patent infringements, the said order allows alleged infringers to continue their infringing conduct by lodging a certain deposit corresponding to the value of a royalty payment to the courts or patent holders. This alternative remedy has been issued mainly in Standard Essential Patent（SEP）cases, and it now extends its scope to non-SEP cases such as pharmaceutical cases. In this paper, trends in the issuance of the interim royalty payment orders are examined throughout history, and transitions of the trends as well as reasons underlying the transitions are firstly discussed. Secondly, the legal requirements of the order are discussed based on the statutes such as the Patent Act, 2002 and the Code of Civil Procedure, 1908 and cases of the High Court of Delhi and the Supreme Court of India. | |||||||||
