| 内容記述 | The purpose of this article is to analyze attempts to theorize matters that lie outside of the court’s activities. The first chapter deals with the project Jus Politicum（droit politique）. In this project, the attention of jurists is often focused on what has been said to be non-legal, namely norms without judicial sanctions. Convention of the constitution is a concept that enables such norms to be theorized. Therefore, the second chapter analyzes the theories of Pierre Avril and Jean Rossetto, who discussed the conventions in France and can be considered to have pioneered the project. By relying on abundant examples in France and analysis of the constitutional structure, they insist that there are political norms despite their legality. This article introduces such an argument and indicates some of its points of contention. | |||||||||
