内容記述 The method for determining culpability has evolved significantly since the decision to introduce Saiban-in trials. The Supreme Court issued important case laws, and for a time it seemed as if the court would move in the direction of respecting psychiatric expert testimony. Later, however, it was decided that the influence of psychiatric expert testimony would be limited, and the professional and lay judges would determine what influence the illness and personality of the offender had on his or her criminal behavior, as legal judgment. This framework seems to facilitate affirmation of culpability. Therefore, at the beginning of the Saiban-in trial, there were few cases that proceeded in the direction of denying the defendants’ culpability. Gradually, however, both district court decisions denying culpability and finding the accused not guilty, and appellate court decisions reversing the district court decisions in the direction of denying culpability, began to emerge. This paper explores the causes of this trend, using delusional disorder as a case study. Since delusional disorder is a mental disorder in which the only symptom is delusion and the mental state other than delusion is normal, the influence of personality on criminal behavior is likely to be affirmed. Two cases of a mass murder with delusional disorder are compared. One is a Supreme Court case that found the defendant fully culpable and sentenced him to death. The other is a High Court case that found the defendant had limited culpability and sentenced him to life imprisonment. This paper explores the factors that led to the difference in judgment.
