| 内容記述 | China, as part of its efforts to improve its death penalty system, has moved to releasing some formal information and materials on wrongful convictions of death penalty cases since 2012. This article aims to explore why and by what wrongful convictions in death penalty cases occur in the Chinese criminal justice system. The following are assumed to be the main causes or factors of wrongful convictions in China. That is, the criminal investigation based on confession; the criminal justice system dominated by criminal investigation; the criminal law enforcement’s style of “Strike -hard Campaign”. This article also concludes that the most important step in preventing wrongful conviction in China is to change its criminal justice system from “A Political Criminal Justice System” to “A Legal Criminal Justice System”. | |||||
