| 内容記述 | This article demonstrates that the so-called non-right thesis of free use（Gemeingebrauch） of a public domain is misunderstood. The thesis has been interpreted in two ways. On the one hand, it can mean that “private persons do not have the right to seek protection from the abolition of public use,” or more specifically, that “private persons are denied the right to sue for the revocation of public use of a public domain”（non-right thesis α）. On the other hand, it can mean that “private persons do not have the right to seek protection from any interference with free use”（non-right thesis β）. The prevailing view condemns the traditional theory because it denigrates the value of free use by adopting the non-right thesis β. However, the traditional theory explicitly rejects the non-right thesis β. Therefore, academics must concentrate their efforts not on criticizing a straw figure but on developing a foundation to overcome the non-right thesis α. | |||||
