| 内容記述 | In this article, I examine Matthew H. Kramer’s recent book H. L. A. Hart（2018） and then discuss some intriguing problems about Hart's legal theory raised by Kramer. Such problems include general methodology, Hart's defense of the positivist concept of law, the internal point of view on power-conferring norms, the “simulative viewpoint”, the nature of Rule of Recognition, and expressivism about legal norms. These discussions indicate the direction the legal positivists should follow. | |||||
