| 内容記述 | Professor Dr. Tetsuo Sato, Emeritus Professor of Hitotsubashi University, has achieved significant research success in international law and international organizational law. His achievements include the legitimacy of international organizations and their decisions, especially the activities of the Security Council of the United Nations. This short article draws its inspiration from Professor Sato’s research and applies evaluation of the legitimacy and effectiveness to the framework and the activities of the International Criminal Court（the ICC）. In December 2017, the Assembly of States Parties to the Rome Statute of the ICC decided to activate the jurisdiction of the ICC over the crime of aggression as of 17 July 2018, when 20 years had elapsed since the adoption of the Rome Statute. The jurisdictional mechanism for the crime of aggression, created by the Rome Statute and the Kampala amendments on the crime of aggression, is complicated and would vitiate some aspects of the legitimacy of the ICC. Therefore, this article elucidates at least a few aspects of the legitimacy of the effectiveness of the ICC in relation to the crime of aggression. | |||||
