| 内容記述 | The Supreme Court judged in the decision on March 27, 2001（Third Petty Bench, 1996（Gyo-Tsu） 210, Minshu Vol. 55, No. 2, at 530） that the Governor’s non-disclosure disposition of public documents in the clause of Osaka Prefecture Public Documents Disclosure Article had been legal and the Governor had not been obliged to make a partial disclosure decision in this case. Although this judgment has been criticized for a long time by many experts, it has not yet been officially changed. Therefore, in this paper, I examine this judgment closely and clarify the significance of this decision through comparing it with the later decision of the Supreme Court on April 17, 2007 （Third Petty Bench, 2006（Gyo-Hi） No. 50, Syumin No. 244, at 97）. In my opinion, this Judgment of the decision on March 27, 2001 is based on the Specificity of the documents concerned, and the value of this decision as a precedent is limited. | |||||||||
