| 内容記述 | In constitutional law, a “federation” is a type of union of states. In accordance with the degree of member’s unification, a union of states can be divided into different types ; “alliance”（united for defense or other purpose）, “confederation”（united closer than alliance but not sovereign）, “federal states”（united and sovereign）, “unified state”（indivisible）. At the beginning of the 20th, in France, such “federal” theories were propounded under the influence of German theories. As one typical example, Louis Le Fur distinguished “confederation and federal state” and Carré de Malberg claimed that “federal state is sovereignty.” Olivier Beaud（Paris II, Constitutional law）explains “sovereign” and “federation” in unconventional ways. His theory proposes the separation of “federation” from “state.” Then, he concludes that “federal state” should not be employed in the explanation, and redefines “federation.” Federation is so horizontal（not vertical）that no one can be sovereign on the one hand, and “state” and “sovereign” traditionally signify vertical, unique, and, individual on the other. He rejects “federal state” because “no sovereignty” of federation is incompatible with “sovereignty” of state. The federal constitution is a “constitutional contract.” The contract is different from the traditional type of constitution: vertical and national. The way of foundation represents federal horizontalness among the member states. Beaud propounds the theory against the international background of the EU. The closer the member states of the EU unite, the less sovereign they become. To give an appropriate legal explanation of the EU as a federation, Beaud decides not to employ “sovereign.” A redefined federation suggests that constitutional law should reexamine traditional terms to take into account the present international world. | |||||||||
