| 内容記述 | In Japan, there are many laws with criminal sanctions. However, in these laws, crimes are not strictly distinguished from disorders, and this has resulted in theoretical problems and obstructed effective law enforcement. In Germany, James Goldschmidt distinguished administrative criminal law from criminal law in his work, “Administrative Criminal Law（Verwaltungsstrafrecht）” published in 1902. Consequently, the Administrative Offences Act（Ordnungswidrigkeitengesetz）of the Federal Republic of Germany was enacted based on the theory of administrative criminal law advocated by Goldschmidt and developed by Eb. Schmidt. The Act is applicable not to crimes, but to disorders. Therefore, it is possible to stipulate procedures that are different from those set forth in the criminal procedure law and that may contribute to effective law enforcement. The theory of administrative criminal law should be studied in Japan in order to achieve effective law enforcement. | |||||||||
